US Judge Orders Freedom of Abrego Garcia from Immigration Detention

Courtroom scene

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.

"Since his release after wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.

The situation stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his repatriation to the United States to answer alien smuggling allegations, he was held in federal custody.

In her decision, the court pointed out that the government lacks a valid removal order, which prevents them from removing Mr. Abrego Garcia "for now."

Background of the Case

The court proceedings center on disputed claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in the state of Tennessee.

Terms of Freedom

The court, who was overseeing his petition to removal in a federal court, ruled that he must now comply with the terms of his bond from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.

This ruling represents a notable development in a complicated legal battle involving allegations of wrongful detention and contested gang associations.
